1.Booking Procedures

Provisional bookings can be requested, which will be held for a maximum of 14 calendar days unless an extension has been requested for in writing and has been approved in writing by Seas4Life Ltd. This extension will only be for a maximum of another ten calendar days. Bookings will be considered confirmed ONLY upon receipt of a 30% deposit of the total reservation amount. Please note that until a 30% deposit is received, Seas4Life Ltd has every right to release any services held. By sending a deposit you are entering into a contract with Seas4Life Ltd and are bound by the following terms and conditions:

2. Payment

Full and final payment must be received in full and funds cleared by Seas4Life Ltd no later than 90 days before the arrival date under the booking (or if the booking is within 90 days, immediately upon booking). If final payment is not received, then Seas4Life Ltd is entitled to release all services with no further liability. In such circumstances the deposit will not be refunded to you and any reimbursement of payment received will be dealt with in according with the section on “Cancellation” below. Payment of invoices to Seas4Life Ltd must be made NETT of any financial transaction charges, unless otherwise agreed.

3. Cancellation / Postponement

Cancellation must be made in writing via email to Seas4Life Ltd. Cancellation notifications must be acknowledged by Seas4Life Ltd in writing in order to be valid. In the event of a valid cancellation notification, the following terms will apply (subject to the Disclaimer and Force Majeure clauses below included with these terms):

  • More than 120 days before arrival, the 30% deposit is refunded, net of bank/payment transaction/currency exchange charges and an admin fee of 3% of the booking value.

  • Between 120 and 91 days prior to arrival, the 30% deposit is forfeited.

  • Less than 90 days to arrival, and no shows, 100% is forfeited.

  • No refund will be given for guests who start a safari but leave before its completion.

Postponement of your booking must be in writing. Funds will be held as a credit for future bookings, valid for up to 12 months from the intended date of travel.

  • More than 90 days (61 days plus) before arrival, 100% of any payment received held as a credit for future bookings.

  • Confirmed safaris postponed under 90 days prior to arrival may incur the costs from 3rd party suppliers.

4. Ground Handling Waiver

In the event of any cancellations, change or delay to client ground handling arrangements by any of our suppliers, Seas4Life Ltd will make every effort to assist the client with rearrangements in the field to minimize disruption to the clients itinerary. Any costs incurred by Seas4Life Ltd in this regard, including any requested changes to the itinerary made after the safari has stared, will be passed directly on to the client or agent. Seas4Life Ltd is not responsible for any travel arrangements made directly by the agent or client.

5. Surcharges

Although the Company hopes that it will not have to levy surcharge, it reserves the right to do so on the invoiced amount should this become necessary due to increases forced upon us by any of our agents or suppliers as well as through exchange rate fluctuations, new government levies or taxes, changes in Park, Reserve, Conservation Area or Community fees. The Company will endeavor to notify you as soon as it is aware of any likely surcharge. This surcharge will apply to all confirmed and invoiced safaris, regardless of whether payment has been received or not by Seas4Life Ltd.

6. Marine Conservation

As part of Seas4life policy, a contribution of US$100 per person per trip is donated to marine conservation work in the area of travel and up to USD$10 per person per day is given to a carbon positive initiative, to protect marine ecosystems through our marine conservation partners (Mikoko Pamoja or Vanga Blue).

7. Insurance & Travel Documents

Seas4Life Ltd insist that you obtain full travel and medical insurance for the duration of the holiday, including (but not limited to) coverage of all activities that you have booked, extreme sports and activities, cancellation and curtailment, missed flight departure or delays, stolen, lost or damaged luggage, medical expenses, personal liability and repatriation.

The onus is on the client to ensure the passports, visas, travel permits, health certificates, inoculations and other documentation required for the trip are obtained and are in order. The Company, their staff and Agents cannot be held responsible for any failure to comply with such requirements. It is the responsibility of the agent / clients to take all appropriate medical advice prior to departure.

8. Force Majeure

Seas4Lfe Ltd shall have the right at any time, at its own discretion, to cancel any trip or the remainder thereof or make any alteration en-route, accommodation, price or other detail and in the event of any tour being rendered impossible, illegal, or inadvisable by any act of ‘Force Majeure’.  This includes (but is not limited to) any event which Seas4Life Ltd or the supplier of the services in question could not, even with all due care, foresee or avoid, such as war or threat of war, civil strife, riot, terrorist activity, industrial dispute, natural or nuclear disaster, fire, sickness, adverse weather, the acts of any Government or public authority and all similar events which are beyond Seas4Life Ltd control. It is regretted that under such circumstances there will be no compensation payable. Please note: we are reliant on information provided by the relevant national Foreign Office.

9. Liability Disclaimer

Seas4Life Ltd and its associated companies and its owners, directors, management and employees shall not assume liability for any illness, injury or death to persons on safari nor for any other incident of any nature involving any client(s) while they are travelling with us. Seas4Life Ltd cannot be held responsible for loss or damage to personal property, however it may be caused.

10. Disputes 

All concerns must be brought to the attention of Seas4Life Ltd or its associated companies prior to the client’s departure in order to finalise the issues on the ground at the time. Should this not be possible then they are to be followed up in writing no later than 14 days after departure where the Kenyan legal system will be adhered to exclusively.

11. Governing Law

The contract and any and all claims arising from it shall be subject to the laws of Kenya.
